Terms and conditions

Art. 1 Application
1.1 These general conditions of sale apply to all supplies of goods and / or services for any reason made by LE ECCELLENZE ITALIANE.it, with orders coming through the LE ECCELLENZE ITALIANE.it website.

1.2 Any changes to these general conditions will be valid only if specifically agreed in writing between LE ECCELLENZE ITALIANE.it and the buyer (hereinafter referred to as "customer").

Art. 2 Orders
2.1 Orders sent by the CUSTOMER, through the LE ECCELLENZE ITALIANE.it website, to LE ECCELLENZE ITALIANE.it have the value of a purchase proposal made at the point of sale, with the exclusion of the Legislative Decree n. 185 of 1999.

2.2 The order can be revoked up to the moment of the order confirmation with the presumed delivery date and the payment request.

2.3 The contract for each individual supply is concluded on the date of the order confirmation made by LE ECCELLENZE ITALIANE.it The unquestionable right of LE ECCELLENZE ITALIANE.it not to accept orders received remains.

Art. 3 Object of the orders
3.1 Each order has as its object exclusively the products and / or services expressly specified and identified by the Manufacturer's product code.

3.2 Any product listings or descriptions are considered explanatory, even if made with reference to other documents prior to the order and not expressly referred to therein and confirmed in writing by LE ECCELLENZE ITALIANE.it.

3.3 The CUSTOMER's order specifically refers to the manufacturer code indicated by the Manufacturer on the item ordered. For clarity, the description or name of the product is indicated together with the Manufacturer code, it being however expressly understood that these descriptions, as well as the technical descriptions on the site, are merely indicative and cannot in any way be considered part of the order.

3.4 LE ECCELLENZE ITALIANE.it is not responsible for the descriptions or technical-informative notes related to the product code and taken from the specifications issued by the Manufacturer and which may change without notice.

Art. 4 Prices
4.1 The prices indicated in the price lists published on the LE ECCELLENZE ITALIANE.it website do not constitute any offer, they are purely indicative and can be modified unilaterally by LE ECCELLENZE ITALIANE.it The price will be valid in the relative order as accepted and confirmed by LE ECCELLENZE ITALIANE.it, pursuant to the previous article 2.3 .

4.2 All prices are in Euros, net of VAT, transport and insurance, at the LE ECCELLENZE ITALIANE.it sales point and for cash payment.

4.3 Other payment methods will give rise to a commission, predetermined in the order confirmation, by way of reimbursement of the management costs of the payment itself.

Art. 5 Delivery
5.1 Each sale is considered completed at the LE ECCELLENZE ITALIANE.it sales point and this is understood that all transport and insurance operations are at the expense of the CUSTOMER.

5.2 Unless otherwise agreed between the parties, contained in the order, LE ECCELLENZE ITALIANE.it freely chooses the carrier, it being agreed that in any case LE ECCELLENZE ITALIANE.it will act as a simple representative of the CUSTOMER who will bear all the costs and risks of the transport.

5.3 In the event that the customer collects or has the goods collected at the point of sale this must take place no later than 8 (eight) days from the date set for delivery in the relative order. If the customer fails to do so by that date, the customer will have to reimburse LE ECCELLENZE ITALIANE.it for the storage and insurance costs in the warehouse, determined at a flat rate equal to 8% (eight percent) of the agreed price of the products for each week of delay. After 30 (thirty) days LE EXCELLENZE ITALIANE will be able to proceed with the free sale to the detriment of the products not collected by the CUSTOMER, without prejudice to the right of LE ECCELLENZE ITALIANE.it to repeat from the customer the lower amount actually collected, including interest and deposit costs, in addition to the amount of the penalty referred to in the following art. 9

5.4 All transport costs and risks, including those stored at the Transporter, remain the sole responsibility of the customer even in the following cases:

  • - refusal of the customer to receive the delivery by the carrier
  • - unavailability of the customer during working days during office hours

5.5 The delivery terms contained in the order begin to run from the date of confirmation of the completion of the purchase procedure (once the terms referred to in Article 8 have been completed) and will end on the date of delivery to the carrier who will deliver the goods within 48 hours. hours, to the address indicated by the customer when ordering. The delivery times indicated by the carrier represent the time normally required to deliver the products and are provided for indicative purposes only.

5.6 The delivery terms contained in the order may in any case be subject to delays for periods not exceeding 30 (thirty) days, without the customer being able to make any objections in this regard, it being understood in any case that after this deadline has elapsed the CLIENT will have the right to withdraw order with written communication to LE ECCELLENZE ITALIANE.it without the right to any compensation for damage and / or compensation.

5.7 In all cases in which the CUSTOMER must present a document of payment or certificates or authorizations from other authorities, the delivery terms will be delayed by a period corresponding to the CUSTOMER's delay in providing such documents.

5.8 In all cases of force majeure, strikes, epidemics, wars, fires, floods, interruptions or delays in transport, objective impossibility and legal measures that prevent, limit or delay the supply of materials, LE ECCELLENZE ITALIANE.it is freed from any and any obligation relating to delivery, without this entailing for the CUSTOMER any right to terminate the order and / or compensation for damages, even indirect, suffered by the CUSTOMER.

Art. 6 Complaints
6.1 Upon receipt of the products, the customer must immediately check the state and conformity of the products.
All disputes relating to the conformity of the products to the order, also in relation to their quantity and / or appearance must be made in writing, under penalty of forfeiture, to the carrier and communicated to LE ECCELLENZE ITALIANE.it no later than 3 (three) days from receipt. It is understood that otherwise such disputes cannot in any way be taken into consideration, not even in relation to any shortages, the results of the delivery note or equivalent title being valid between the parties. Any defects and / or hidden defects of the products must be reported in writing, under penalty of forfeiture, no later than 8 (eight) days from discovery.

Art. 7 Warranty
7.1 All items marketed by LE ECCELLENZE ITALIANE .it are produced by leading manufacturers and the execution of
guarantees is carried out by the assistance centers set up by them in Italy. The methods of providing assistance under warranty are indicated by the manufacturer, which are independent from the operation of LE EXCELLENZE ITALIANE In cases where the manufacturer does not work directly with its own assistance centers (with particular reference to OEM products) but makes use of the collaboration of LE ECCELLENCES ITALIANE.it the RMA procedure has been established whose implementation regulation is an integral part of these Conditions of sale.

7.2 The guarantee does not cover materials or parts thereof, which are subject to normal wear, such as rubber seals, parts in
plastic, as well as all consumables. Damages caused by the customer or third parties due to inexperience and / or negligence and those resulting from transport are also excluded.

7.3 In any case, the CUSTOMER loses the right to guarantee if, without the written authorization of the manufacturer and / or LE ECCELLENZE ITALIANE.it, they disassemble, modify, tamper with the products or for misuse.

7.4 In order for the guarantee to be effective, all returns must, subject to RMA authorization, reach the point of sale, and must:

  • be packed in their original packaging, suitable packaging is sufficient for OEM products.
  • be complete in all parts and accessories and software provided at the time of purchase.
  • do not present any tampering or damage not deriving from a manufacturing defect.

7.5 The warranty does not, however, cover labor costs or those resulting from operations of
disassembly, assembly and transport. In any case, in all cases in which the products are compliant and / or non-defective, an intervention amount of not less than € 45 will be due as reimbursement of expenses for each product for which assistance has been requested.

7.6 The parties expressly agree that LE ECCELLENZE ITALIANE.it will in no way be held liable to the CUSTOMER for direct and / or indirect damage to goods other than those supplied or for damage as a result of damage suffered by the products supplied.

Art. 8 Payments
8.1 All payments, unless otherwise confirmed in the order confirmation, are intended in cash.
In any case, in all other payment methods, the expiry of the delivery terms will start from the moment of certainty of the crediting of the amounts due.


Art. 9 Right of withdrawal
9.1 As an exception to the provisions of art. 3.1, the right of withdrawal is accepted as provided for in Article 2.2.

9.2 The right of withdrawal is excluded:

  • and pursuant to art. 5 paragraph 3 letter d of Legislative Decree 185/1999, relating to audiovisual products and sealed computer software, if open.
  • and pursuant to art. 5 paragraph 3 lett. c of Legislative Decree 185/1999, relating to personal computers at the request of the Customer (as they are built "to measure" and therefore customized to his specification), as well as in the case of particular products whose supply was made upon explicit request to fulfill personal needs of the customer.
  • consumables, if opened.


9.3 to exercise the right of withdrawal, the Customer must send a notice, sent in advance by fax or email, by registered letter with return receipt, to the LE ECCELLENZE ITALIANE.it sales point.

9.4 Upon receipt of the notice of withdrawal, LE ECCELLENZE ITALIANE.it, having ascertained its regularity, will communicate to the customer the instructions on how to return the products.The goods must be returned in their original packaging and perfectly intact, complete with all its parts (documentation and equipment accessory), and sent, at your expense, with insured shipping.

Art. 10 Penalties
10.1 In all cases of termination of an order following non-fulfillment by the CUSTOMER, a penalty equal to 20% (twenty percent) of the amount of the order not executed as a result of the non-fulfillment will be due to LE ECCELLENZE ITALIANE.it, without prejudice to compensation of any greater damage.

Art. 11 Duration
11.1 These General Conditions will apply to all supplies of products and / or services made and concluded at the LE ECCELLENZE ITALIANE.it sales point.

Art. 12 Jurisdiction
12.1 All disputes arising from these General Conditions and / or from orders executed based on them
will be devolved to the jurisdiction of the Orvieto court, without prejudice to the possibility for LE ECCELLENZE ITALIANE.it to convene the CUSTOMER at the court of his domicile or to accept arbitration from the authorities in charge for this purpose.
